Heard on the street.....here's the latest story in NYT, this one reporting on the behind the scenes calls from elected officials to city hall and brookfield and calls between city hall and brookfield. The impression article gives is that Bloomberg has "no power over" Brookfield -- which is disingenuous given that Ms. Taylor is on B'field's Board. No pillow talk at all? Ha! Reason seems to be: Bloomberg very nervous about violating constitution by clamping down on OWS -- however, First Amendment (and rest of Bill of Rights) ONLY applies to "state actors" -- therefore, he and NYT are banking that they can keep Brookfield a private actor so that when Brookfield starts doing things under covert pressure from B'berg (via Taylor or not) . . . City in later lawsuits can argue that it did nothing and Brookfield will argue it's not a "state actor" therefore not subject to constitutional damages or injunction.
